Beschreibung: Recently, the AG rendered its opinion in the intriguing Anne Frank referral (C-788/24) submitted by the Netherlands Court. The referral asked the CJEU inter-alia to clarify that whether mere accessibility of a work by the use of Virtual Private Networks (VPN) from a MS where copyright protection applies, constitutes as an ‘act of communication to public’ in accordance with Article 3(1) of the EU InfoSoc Directive, even if the provider of the work is located in a MS where the copyright protection of it has already expired. – virtual Private Networks – act of communication to public – ‘adressing’ and ‘directing’ – expired copyright protection – full knowledge
